Upon termination of the contractual relationship or revocation of consent for data processing, all personally identifiable information collected, processed, and stored by Vertexa will be deleted, except for records necessary to fulfill legal obligations and exercise the right to defense in potential judicial and/or administrative proceedings.

4. Methods and deadlines for the use and storage of your personal data

When collecting your data, Vertexa is committed to storing them in secure technical and structural conditions, following the highest technical standards of information technology and data security.

The data is stored in databases provided by Amazon Web Services, Vultr, and Google, and, when applicable, in third-party partner databases, following the highest security standards.

Such data is stored until the contractual relationship between the user and Vertexa ends and for a period of 1 (one) to 5 (five) years after its termination, except for the information necessary to fulfill legal obligations and exercise the right to defense in potential judicial and/or administrative proceedings, as provided in Article 15 of the Marco Civil and Articles 15 and 16 of the General Data Protection Law.

The storage of data is carried out in databases of highly reliable companies with international recognition, following high standards of cybersecurity and information technology.

5. How to request the alteration or deletion of your personal data

Users can request the correction and/or alteration of data at any time. For this purpose, Vertexa provides its users with an exclusive email channel for inquiries regarding personal data: [email protected].

If you revoke your consent for data processing or after 5 years from the termination of the contractual relationship, the collected and stored personal data information, as well as access to it, will be deleted.

However, personal data information may be stored in accordance with the law. This includes the maintenance of records necessary for legal obligations, potential defense in judicial or administrative proceedings, and exclusive use by Vertexa for fraud prevention, business security, and system improvements.

The personal data of users of Vertexa’s services, as well as its employees and service providers, may only be shared with third parties in the following cases:

We request users to exercise the utmost confidentiality regarding their personal data resulting from the use of the service (such as login and password, for example) and to adopt secure mechanisms to protect their devices (computer, mobile phone, tablet, etc.). We are not responsible for the imprudence or negligence of our users in managing their data or for malicious actions by third parties, unless the negligent or deliberate conduct of Vertexa is proven.

Vertexa is not responsible for the accuracy of the information provided by the user when registering to use the services. False or malicious information provided by the user for the use of the services is entirely their responsibility.

Vertexa is not responsible for malicious actions by third parties unless negligent or deliberate conduct by Vertexa is proven; see the section below.

Vertexa’s Responsibilities

When necessary, data processing will be carried out within the purposes and appropriate measures described in this Privacy Policy. Vertexa ensures that the agents involved in these processing activities comply with the provisions of the General Data Protection Law (Law 13,709/2018), specifically articles 42 to 45 of the Law.
